Terms & Conditions

These Terms govern the supply of the property video production services (“flythroughs”) offered by AeroStay through aerostay.io and its associated channels (WhatsApp, email). By placing an order, the client accepts these Terms.

1. The service

AeroStay produces cinematic property videos generated by AI scene reconstruction from the photographs or listing links supplied by the client. No drones and no physical filming are used. The result is a faithful cinematic recreation of the property, not drone or camera footage.

2. Orders

The client requests the service via WhatsApp, email or the website, specifying the property and the package required. The contract is formed when the client accepts the quotation.

3. Client obligations

• Supply photographs or listing links of sufficient quality.
• Warrant that they hold the rights to the images supplied and are authorised to use the property for commercial promotion. The client indemnifies AeroStay against any third-party claim on this basis.
• Provide the information needed for delivery (intended use, branding, and similar).

4. Fidelity and scope

Videos are faithful to the property supplied. No non-existent rooms or features are added. Where two spaces share no visual continuity, editorial cuts are used rather than invented transitions. Each video is reviewed shot by shot before delivery.

5. Prices and payment

Applicable prices are those published or stated in the quotation, plus VAT where due. Accepted payment methods: Stripe (card), bank transfer and Bizum. Monthly plans (retainers) are billed in advance.

6. Delivery

Standard delivery is 48 hours (24 hours on priority plans) from receipt of all suitable material. Delivery times depend on the material supplied being adequate for production.

Unless otherwise agreed, the client receives: a 16:9 widescreen file, a 9:16 vertical file and a YouTube link, with no watermarks.

7. Revisions

One (1) round of revision is included, covering pacing, ordering or music. Additional revisions or changes of scope are quoted separately.

8. Satisfaction guarantee

If the final video does not faithfully reflect the client's property, the client is not obliged to pay for the affected deliverable. This guarantee covers fidelity to the property; it does not cover changes of subjective preference outside what was agreed.

9. Right of withdrawal (consumers)

Where the client is a consumer contracting at a distance, a 14-day withdrawal period applies under EU and Spanish consumer law. However, as this is a service producing personalised content, where the client requests that production begin immediately and expressly acknowledges losing the right of withdrawal once the service has been performed, that right cannot be exercised over work already completed.

10. Intellectual property

Once payment is made, the client obtains the rights to use and exploit the delivered videos for marketing the property (portals, social media, website and marketing materials), with no time limit and no royalties.

AeroStay may display the videos in its portfolio and promotional materials unless the client expressly opts out in writing.

11. Liability

AeroStay is not responsible for the client's use of the videos or for statements about the property made outside the production. AeroStay's liability is limited to the amount paid for the affected service.

12. Data protection

Personal data is processed in accordance with our Privacy Policy, the GDPR (EU 2016/679) and Spanish data protection law (LOPDGDD).

13. Changes

AeroStay may update these Terms. The version in force at the time of each order applies.

14. Governing law

These Terms are governed by Spanish law. Consumers retain the mandatory jurisdiction rights granted to them by law; in all other cases, the parties submit to the courts of Marbella, Spain.
